We are using Visual Studio 2008.
we are on Vault version 3.16 (3658 SG).
Alot of developers are complaining that some times when they check out a file, it isn't always the latest version.
Do you know if there is some kind of switch that would "auto-get latest" when ever anyone checks out a file?

A checkout should get the latest version of a file, unless the file is modified locally. Does this happen if the local file is different than the latest in the repository?
If so, check the setting in Visual Studio ->Tools->Options->Source Control->Plugin Settings->Advanced->Local Files->Modified Working Copy. Change the option Overwrite. Or you might be able to change it in the Vault GUI Client under Tools->Options->Local Files->Modified Working Copy.
We have never tested VS 2008 with Vault 3.1.x, and don't support it, so it's possible something else is going on.
